The business, the turning points, and the decisions behind them.

01 / WHAT IT BUILT

What the company did

Muxtape was a music mixtape sharing site founded by Justin Ouellette, a former staffer at Vimeo. Launched in March 2008, it let users upload up to twelve MP3s to a unique URL (*username*.muxtape.com) that behaved as a streaming digital mixtape — a sensation that drew nearly 98,000 signups in its first month. On August 18, 2008 the service went dark, its front page reading 'Muxtape will be unavailable for a brief period while we sort out a problem with the RIAA': the RIAA had filed a complaint with Amazon over the files Muxtape hosted on AWS, and Amazon cut access. It returned in January 2009 as a minimalist platform for independent bands to promote their music.

02 / muxtape FAILURE REASONS

Failure reasons

Muxtape was killed by music-industry licensing pressure, not by lack of users. Even though Ouellette was already in talks with the four major record labels, the RIAA complained directly to Amazon and the hosting was shut off mid-negotiation. Ouellette wrote that the legality was moot: he had no money to defend against a lawsuit, just or not, so the labels held an axe over his head either way. Licensing discussions bogged down in demands for egregious per-song royalties and fees at every step (encoding, copying, playback); rather than fight, Ouellette switched to an invite-only platform built around original band content.

How the factors connect

  1. 01

Muxtape was a bootstrapped solo-founder project; no audited financials or loss figures were disclosed. The available record describes unaffordable legal exposure, not a corporate loss with disclosed subject, period and basis.
